KEY DEVELOPMENTS

– The Government of Kenya (GOK) continues to facilitate the return of approximately 350,000 internally displaced persons (IDPs) from temporary shelters in camps and host communities to pre-crisis lands. Between May 2 and 22, the number of IDPs residing in camps decreased from 158,891 to 95,454 and the number of camps declined from 157 to 124, according to the Kenya Red Cross Society (KRCS).

– Relief agencies report that the majority of returnees are farmers moving back to agricultural areas. Some IDPs, including some small business owners and landless individuals, continue to indicate a reluctance to depart camps without government assistance to help reestablish livelihoods. In addition, ongoing security concerns and the perceived need for further reconciliation is hampering returns in some areas.

– The Office of the U.N. High Commissioner for Refugees (UNHCR) and the GOK are working to register IDPs in host communities and return sites in order to provide targeted humanitarian and livelihood assistance to these populations. Registration is scheduled to be complete by June 30, although population movements are complicating the process.

– USAID/OFDA’s Early Recovery Team continues to monitor the returns process throughout affected areas of western Kenya, facilitate coordination and information sharing among U.N. and relief agencies, and work with implementing partners to support sustainable returns and early recovery.

Kenya Post-Election Emergency Response: Food Assistance Sector

Situation Overview

Kenya Red Cross(KRC), Government of Kenya(GoK), Office of the President/Special Programmes, and WFP are coordinating the single-food-pipeline and food assistance activities in Kenya, building on the existing food assistance coordination mechanisms in Kenya.

According to Government statistics, the ‘Rudi Nyumbani’ (Return Home) operation recently launched has so far seen an estimated 125,000 persons resettled by the Government; actual numbers are lower. Population in camps is reducing, but a significant group mainly of traders, landless persons and other vulnerable groups without land to return to are likely to remain in the camps; Population in 134 IDP camps stands at 113,065.

WFP/KRC has agreed to provide the returnees with a one month ration during this transition. However, lack or coordination and consultations during the exercise have in the past week resulted in reported incidences of persons leaving the camps without food allocations as camps were hurriedly closed posing difficulties in assessing and establishing locations where these persons moved to supply them with the necessary food requirements.

The general security situation in the country was calm. Few incidents of road banditry, hijacking of public transport means, robbery and violence against passengers were reported over the week, but in no way related to the post election crisis. There was reported tension in Mandera and along the Kenya/Somali border as the Kenyan security forces beefed up their presence after the killing of the Islamic Court Union militant commander in Somalia last week. In Mt. Elgon, military operations to neutralize the sabaot land defence force are ongoing; yesterday 18 May, 2008, the leader of the force was killed by police.

GoK, KRC, WFP, and partners have jointly delivered 13,354 mt of assorted food. WFP stocks are in place at four operational hubs (Eldoret, Kisumu, Nakuru, Nairobi), in addition to GoK and KRC stocks, to respond to identified needs for the current distribution. WFP will face pipeline breaks for cereal shortfalls in June, and pipeline breaks for all commodities from July onwards.

However, with the recent launch by the Government of ‘Rudi Nyumbani’ (Return Home) operation, these figures are expected to change rapidly. Camp registers are expected to be helpful in tracking beneficiaries’ movement.

The security situation has returned to calm in most of the country. Highways were accessible and no post-election related violence was reported. However, a few incidents of road banditry, hijacking of public transport means, robbery and violence against passengers were reported end of last week. The incidents were by no means limited to post-election crisis areas. UNON security mission team is currently visiting post-election crisis areas to review the security situation and recommend a security phase level.

I. General Overview

During their three-day tour of Rift Valley Province, President Kibaki and Prime Minister Raila Odinga encouraged communities to reconcile so that displaced people could return home and farm to alleviate the looming food crisis. MPs from Rift Valley province have put forward their own pre-conditions for the resettlement and return of IDPs which are: 1) for suspects arrested for participating in the post-election to be released, 2) for those displaced from Mau Summit during President Kibaki.s first term to be resettled and 3) the termination of the military operation in Mount Elgon. They feel all of these actions are unfairly targeting the wider Kalenjin community. Nevertheless, the visit is seen as a positive step as it shows the issue of return and resettlement is high on the political agenda.

Mediated talks on long-term constitutional, institutional and legal reforms, known as Agenda Four, resumed. The reforms aim to resolve the underlying causes of Kenya.s political crisis. A Commission of Inquiry on Post-Election Violence will be officially established on 1 May, chaired by Kenyan Court of Appeal Judge Philip Waki. A draft bill to establish a Truth, Justice and Reconciliation Commission is being finalized. The commission will investigate human rights violations, economic crimes, including corruption and historical land injustices, committed since independence.

The chairman and the treasurer of the outlawed Mungiki sect were shot dead on 28 April. Analysts believe that the sect is experiencing a power struggle over its leadership. As a result of these recent killings, the sect cancelled its first planned reconciliatory meeting with church and government officials.

Floods have displaced at least 38 families in Homa Bay and Nyando districts in Nyanza Province. The Kenya Red Cross Society (KRCS) is responding with blankets, mosquito nets, food, aquatabs, cholera kits, shelter materials and medical treatment.

KEY DEVELOPMENTS

– According to USAID/OFDA staff, on May 5, the Government of Kenya (GOK) launched an initiative in Rift Valley Province to facilitate the return of internally displaced persons (IDPs) to pre-crisis lands. USAID/OFDA staff report that IDP returns appear to be voluntary and note no evidence of forced returns to date. However, USAID/OFDA staff report concern regarding the sustainability of recent returns in some areas and the lack of GOK coordination with the humanitarian community prior to the implementation of the return operation.

– On May 2, the USAID Disaster Assistance Response Team (USAID/DART) transitioned to an early recovery team, following improvements in Kenya’s political environment and stabilized humanitarian conditions in IDP camps and host communities. The demobilization of the USAID/DART reflects the shift from an acute emergency to early recovery in Kenya following post-election violence.

– USAID/OFDA will maintain a presence in Kenya to monitor the humanitarian situation; oversee USAID/OFDA-funded relief, early recovery, and disaster risk reduction programs; and facilitate coordination and information sharing regarding response and early recovery efforts.

The latest statistics from KRC show 157,585 IDPs in 182 camps and an additional 130,000 in host communities.

The security situation has returned to calm in most of the country. Last week, there were violent protests in parts of the country by the Mungiki sect with similarly belligerent reactions by police; however a government announcement that it would engage in discussions with the sect ended the protests. Tension still remains high in Trans Nzoia and Mt. Elgon district due to ongoing military operations aimed at flushing out SLDF Militiamen from Mt Elgon.

ELDORET, 1 May 2008 (IRIN) – Along the Nakuru-Eldoret road, the charred remains of homes and businesses scar the picturesque landscape of Kenya’s Rift Valley province and serve as a reminder of two months of violence that rocked the nation early this year.

The calm that is typical of most rural settings belies the suffering experienced by thousands of internally displaced persons (IDPs) since fleeing their homes in January and February.

“We are starting the third month of living in tents yet I don’t see myself leaving soon because I am afraid nothing has changed out there,” Rosemary Kuria, an IDP at a camp in Eldoret, told IRIN.

Fear of attacks should they return home and the hope of receiving compensation from the government seem to be two key issues for most IDPs, and contribute to their seeming reluctance to return home even after the formation of a coalition government a month ago, which was to have marked the end of their displacement.

KEY DEVELOPMENTS

– The April 13 announcement of the formation of a coalition cabinet has led to a reduction in tensions in areas of Kenya affected by the post-election crisis. However, USAID Disaster Assistance Response Team (USAID/DART) staff caution that the overall security situation remains tenuous.

– On April 14, the U.N. and non-governmental organizations (NGOs) launched a revised appeal for $189 million targeting internally displaced persons (IDPs) and other populations impacted by Kenya’s post-election violence, as well as families potentially affected by drought. The revised appeal supplements the original $41.9 million Kenya Emergency Humanitarian Response Plan announced on January 16 to assist 500,000 people affected by the postelection violence.

– On April 10, USAID/OFDA airlifted 300 rolls of plastic sheeting from USAID/OFDA’s Dubai warehouse to Eldoret town, Rift Valley Province, to upgrade existing camp shelter resources in response to protracted displacement needs compounded by the onset of the March rains. The emergency relief commodities, valued at more than $165,000 including transport, will improve shelter conditions for approximately 50,000 beneficiaries.

– The USAID/DART continues to conduct field assessments throughout affected regions of central and western Kenya, engage with U.N. and partner relief agencies to identify evolving humanitarian needs, and facilitate coordination and information sharing regarding response and early recovery efforts.

Dear Colleagues,

Please find enclosed the revision of the ACT appeal for Kenya (AFKE81) which now includes activities by Diakonie Emergency Aid (DEA) and four partners of the Anglican Church of Kenya, as well as changes on some of the activities and areas of interventions by Christian Aid, Church World Service, Lutheran World Federation, Lutheran World Relief and Norwegian Church Aid.

Following the elections in Kenya on 27 December 2007 and allegations of vote-rigging, sporadic violence broke out in many parts of the country between supporters of Party of National Unity and the Orange Democratic Movement . At least 1,000 people died and thousands were displaced due to the violence. On 28 February 2008, the two political factions signed a power-sharing agreement which was greeted with jubilation and relieve in many parts of the country.

However, while the political deal has been agreed upon, and peace resumed in many parts across the country, majority of the displaced families are still living in IDP camps. Many fear to return to their homes, particularly in the Rift valley province where many deaths were reported during the peak of the crisis. Continued clashes for different reasons were witnessed in Mt. Elgon and Laikipia Districts (resource related conflict especially land and water) and have created fears for IDPs to return home.

Based on the current official information released by the Government and the Kenya Red Cross, over 250,000 people still remain in the IDP camps. In recognition of continued humanitarian needs in Kenya, the international humanitarian community began a process of revising its Emergency Humanitarian Response Plan. Simultaneously, a process of contingency plan for possible deterioration of the humanitarian situation is being finalised. Aid agencies led by the UN Protection Cluster are refining a draft plan for durable solutions to assistance being offered to IDPs in Kenya.

On 12 March 2008, the ACT Kenya Forum (AKF) participated in a UNDP stakeholders workshop which marked the start-up of the UNDP work plan development process built upon five lines of actions- peace and reconciliation, stabilization, livelihoods, access and delivery of basic services and mainstreaming of cross cutting issues. This revised appeal therefore takes into consideration the UNDP focus areas of intervention in order to ensure their sustainability, promote spontaneous recovery and coping initiatives of IDPs and pave the way for long term recovery.
