UN Expert calls for renewed efforts to protect and assist Kenya’s internally displaced persons as essential to conflict resolution and peacebuilding

Nairobi and Geneva, 27 May 2008 – “At this crucial beginning of recovery, special efforts by the government, humanitarian agencies and the donors are essential if the return of those displaced by the post-election violence is to be sustainable and compatible with international human rights standards. In the absence of substantially increased efforts, we will jeopardize the fragile process of building and restoring of peace in displacement affected communities.” This is the main conclusion of Walter Kaelin, the Representative of the UN Secretary General on the Human Rights of Internally Displaced Persons, at the conclusion of his working visit to Kenya, from 19 to 23 May 2008.

The Representative commended the Government of Kenya, the Kenyan Red Cross, the international humanitarian organizations and the people of Kenya for the effective assistance and support provided to those living in camps since they were displaced by the post-election violence of December 2007 and January 2008. Today, the government’s effort to return the displaced from camps to their fields and homes (Operation Rudi Nyumbani) create particular challenges. These challenges include ensuring that returns are safe and voluntary, providing humanitarian assistance in the areas of return and at the transit sites, and restoring full protection of the IDPs’ human rights in accordance with the UN Guiding Principles on Internal Displacement. I. General Overview

Discussions are ongoing within the Grand Coalition Government to determine the structure and respective powers of the President, Prime Minister and Vice President. The Government composition is intended to ensure a genuine coalition is formed, with the representation required to arbitrate disputes.

The Prime Minister traveled to Kisumu District in the Nyanza/Western Region, where support for his party, Orange Democratic Movement (ODM), is strong. During his tour, the Prime Minister stated that a new constitution would be prepared within the year. Land legislation and past grievances continue to drive conflict throughout Kenya; as a key element of Agenda Item Four, which will include longer-term solutions to the drivers of conflict, the new constitution is expected to address land legislation. – According to USAID/OFDA staff, on May 5, the Government of Kenya (GOK) launched an initiative in Rift Valley Province to facilitate the return of internally displaced persons (IDPs) to pre-crisis lands. USAID/OFDA staff report that IDP returns appear to be voluntary and note no evidence of forced returns to date. However, USAID/OFDA staff report concern regarding the sustainability of recent returns in some areas and the lack of GOK coordination with the humanitarian community prior to the implementation of the return operation.

– On May 2, the USAID Disaster Assistance Response Team (USAID/DART) transitioned to an early recovery team, following improvements in Kenya’s political environment and stabilized humanitarian conditions in IDP camps and host communities. The demobilization of the USAID/DART reflects the shift from an acute emergency to early recovery in Kenya following post-election violence.

– USAID/OFDA will maintain a presence in Kenya to monitor the humanitarian situation; oversee USAID/OFDA-funded relief, early recovery, and disaster risk reduction programs; and facilitate coordination and information sharing regarding response and early recovery efforts.

Assessments and Events

– On 8 April, the key political parties announced a suspension in their dialogue. The UN fears that this could slow or halt progress made in returning thousands of IDPs to their homes.

– Social networks are disrupted and health services are under pressure. Risks are particularly acute for people with chronic conditions, like TB or HIV/AIDS, who depend on regular medication.


– WHO and the Health Cluster partners (UNICEF, UNFPA, the Kenyan Red Cross, international and local NGOs, community- and faith-based organizations) continue to support the MoH in facing the increasing demand for care.

– In the context of the Emergency Humanitarian Response Plan, WHO is requesting external assistance to:

  • strengthen coordination and health information management (assessments, monitoring, dissemination) in the most critical provinces as well as in Nairobi;
  • ensure surveillance and respond to disease outbreaks;
  • strengthen primary health care services and ensure the availability of medical supplies in IDP camps and host communities.

– Under the revised Response Plan, WHO is requesting US$ 1 177 000, of which 395 700 have already been received from the CERF, Australia and Turkey. WHO also advanced US$ 240 000 from its own regular budget.
