KNCHR documentation, investigation and analysis of human rights violations project

The Kenya National Commission on Human Rights (KNCHR) is mandated by its constitutive Act, the Kenya National Commission on Human Rights Act No 9 of 2002, to promote and protect human rights. Pursuant to that mandate, the Commission is currently conducting investigations with a view to providing, through the voices of Kenyans and other sources, an impartial account of the post election violence and the events that have taken place since the announcement of the disputed presidential election results on 30th December 2007. We intend thereby to maintain an accurate record of this part of Kenya’s history as well as to identify perpetrators who must be held to account in order to end the culture of impunity.

For this purpose, the KNCHR has deployed teams throughout Kenya to investigate the violence.  We aim to have a preliminary report presented to the public within two months, which will give an impartial account of the recent violence. Based on the information gathered, we will make the necessary recommendations including asking the national law enforcement and prosecution authorities to undertake proper criminal investigations and prosecutions where the Commission has sufficient and credible information that crimes have been committed.

It is our hope that this will go some way towards removing the shield of impunity for the planners and perpetrators of such predatory enterprises and that the report from this work will put in Kenya’s national collective memory the plight of all of the victims of the violence.  We also hope that these investigation and monitoring efforts will serve to prevent ongoing acts of violence.

The KNCHR is working with both local and international partner organizations who are working towards the same goal and who are providing assistance in all aspects of the work .
